Acceptance of Terms

By using this Site or accessing Squirrel's Services, you agree to comply with these Terms of Service (“Terms”). Please read these Terms carefully before continuing. If you do not agree with any portion of the Terms, do not use the Site or Services. Throughout these Terms, “you,” “your,” and “yours” refer to the user, while “Squirrel,” “we,” “us,” and “our” refer to the company. “Party” or “Parties” refer to both you and Squirrel. These Terms form a binding agreement between you and Squirrel.

1. Updates to the Terms of Service

Squirrel reserves the right to update these Terms periodically at its discretion. Any updates will be reflected with the “Last Updated” date and published on this Site. In cases of significant changes, we will notify you as required by law. Continued use of the Site or Services after the changes take effect indicates your acceptance of the revised Terms.

2. Appropriate Site Usage and Account Registration

To access Squirrel's Site or Services, you must be at least 18 years old and possess the authority to agree to these Terms. If you are agreeing on behalf of an organization, you confirm that you have the authority to bind that entity. In such instances, “you” and “your” will include both you and the entity.

Certain features of the Site or Services may require you to complete an order form (“Order Form”) provided by Squirrel. If any terms in the Order Form conflict with these Terms, the Order Form will take precedence.

Account registration may be required to use specific parts of the Site or Services. You agree to provide accurate, complete information during registration and to keep your account secure. Notify Squirrel promptly of any unauthorized access or security issues. You must not use another person's account, impersonate others, or provide false information.

3. Subscription and Other Payments

Certain Services are subject to fees, either on a subscription or ad hoc basis (“Service Fees”). By utilizing these fee-based Services, you agree to pay the applicable charges promptly. When you provide payment information, you confirm you are authorized to use the provided method and permit us to charge it, including for applicable taxes.

Squirrel may adjust Service Fees, which will take effect with the next renewal term or as specified in the Order Form. If you subscribe, we will notify you in advance of any changes and explain your options. Continuing to use the Services after a price adjustment constitutes your acceptance. If you do not agree, you may cancel your subscription before the new pricing becomes effective.

4. Subscriptions

By purchasing a subscription, you authorize Squirrel (or a third-party payment processor, such as Stripe) to charge you based on the agreed schedule. Subscriptions remain active for the duration specified in the Order Form unless terminated earlier as outlined in these Terms.

To cancel your subscription, contact us at support@usesquirrel.com. Pre-paid subscription fees are non-refundable unless otherwise agreed.

5. Consent to Recording

Squirrel uses conversational AI technologies to optimize hiring workflows. These technologies may involve recording audio, chat, and other transmissions, and we may expand to include video recordings in the future.

You agree to provide Squirrel with reasonable access to hiring results to evaluate usage metrics and calculate fees under these Terms or any Order Form.

By using our Services, you agree that:

  • You consent to the recording of communications involving you and any other participants during Service use.
  • You will use Squirrel's tools in compliance with all applicable privacy laws, including obtaining required consents for recording communications.
  • You are solely responsible for compliance with recording regulations and obtaining necessary permissions from job candidates or other participants.
  • Squirrel may limit or suspend access to the Services if they pose privacy or security risks.

6. Changes to the Site or Services

We may modify or discontinue all or part of the Site or Services at any time without notice. If you have paid for Services, any changes will not materially degrade the functionality or performance of those Services. We are not liable to you or third parties for modifications, suspensions, or discontinuation.

7. Communication from Squirrel

By using the Site or Services, you agree to receive communications from Squirrel, including marketing emails. You can opt out of marketing emails by following the provided unsubscribe options.

Squirrel may also contact you via email, calls, or text messages for account notifications, issue resolution, surveys, or other necessary communications. Reply STOP to opt out of marketing texts, and note that message and data rates may apply. Consent to marketing communications is not required for using the Services.

8. Licenses

Squirrel grants you a limited, non-exclusive, and non-transferable license to use the Site, Services, and content for internal business purposes. Authorized users may access the Site and Services under the terms specified in the Order Form.

9. Restrictions

You are responsible for all User Content you provide and agree to comply with these Terms and applicable laws. You may not:

  • Store, copy, or modify our content without authorization.
  • Use automated tools, sublicense, or resell the Services.
  • Engage in activities that compete with or harm Squirrel.

Violation of these restrictions may result in termination of your access.

10. Ownership

Squirrel and its affiliates retain all rights to the Site, Services, and content. You may not use our trademarks or service marks without prior consent.

You retain ownership of your User Content but grant Squirrel the right to process it to provide the Services. You must ensure your User Content complies with applicable laws and does not infringe on third-party rights.

To the extent that User Content includes personal data subject to applicable data protection laws, including the EU General Data Protection Regulation (“GDPR”), the terms of Squirrel's Data Processing Policy (“DPP”) shall govern the processing of such data. The DPP ensures compliance with GDPR and other relevant laws, detailing how personal data is handled securely and lawfully. Squirrel may amend the DPP as necessary to adhere to evolving legal requirements, and the latest version will be available on our website. By using our Services, you agree to the terms of the DPP.

Additionally, you acknowledge and agree that Squirrel may anonymize and aggregate User Content into anonymized datasets (“Anonymized Data”), which cannot reasonably identify individuals. Squirrel retains the right to use Anonymized Data to improve its software, analyze trends, and for other lawful purposes.

11. Confidentiality

Both parties may share confidential information as needed. Confidential information excludes publicly available or independently developed information. Obligations of confidentiality last five years after disclosure, except for trade secrets, which remain protected indefinitely.

12. Termination of Access

Squirrel reserves the right to restrict or terminate access to the Site or Services for any reason, with or without notice. Termination does not absolve either party of their obligations under these Terms.
